These Terms of Service (“Terms”) govern your access to and use of the website and AI automation services (the “Services”) provided by LoopIQ Inc (“we,” “us,” or “our”), a Virginia corporation. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
1. SERVICES OVERVIEW
LoopIQ Inc provides AI automation, workflow integration, and business optimization services, including but not limited to Missed-Call Text-Back automation for home service contractors. You agree to use the Services only for lawful purposes.
2. USER ELIGIBILITY
To use our Services, you must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are using the Services on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
3. SMS & TEXT MESSAGING (A2P 10DLC COMPLIANCE)
By providing your phone number and utilizing LoopIQ’s SMS automation features, you agree to the following:
- Program Identity: SMS messages are sent by LoopIQ Inc.+2
- Consent: You represent that you have obtained “prior express written consent” from your customers to contact them via SMS. For missed-call text-backs, you agree to provide clear notice on your website or voicemail that an automated text may be sent.+1
- Message Frequency: Message frequency varies based on your interaction with the Services and your customer inquiries.+2
- Fees: Standard message and data rates may apply.+1
- Support: For assistance, reply HELP or email ajay@loopiq.io.+2
- Opt-Out: You or your customers can opt out at any time by replying STOP. You may receive one final confirmation message after opting out to verify the request.+1
- Carrier Compliance: You are prohibited from using the Services to send content related to debt collection, tobacco/vaping, gambling, or any prohibited “SHAFT” categories.+1
- Carrier Liability: Carriers are not liable for delayed or undelivered messages.
4. AI OUTPUT & CLIENT RESPONSIBILITY
LoopIQ utilizes artificial intelligence to automate workflows. You acknowledge that AI-generated content may occasionally contain errors. You are responsible for reviewing AI outputs and ensuring the accuracy of information provided to your end-customers.
5. PAYMENT & BILLING
Fees are payable according to the pricing displayed at checkout or in your service agreement. 50% is due upfront to begin implementation, and 50% is due upon completion of the setup phase. All fees are non-refundable.
6. DATA PRIVACY & SECURITY
Your use of the Services is also governed by our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.+1
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, LoopIQ Inc will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Total liability will not exceed the fees paid by you to LoopIQ in the three (3) months preceding the claim.
8. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Virginia. Any legal action shall be brought exclusively in the courts located in Virginia.
